ECS provides service to the residence of Los Angeles, Beverly Hills, Hollywood, Santa Monica and surrounding cities. Small Claims Court actions are civil matters in the amount of $7500.00 or less. There are no lawyers and no juries present, only the Plaintiff, Defendant and the Judge. The Plaintiff is the person that starts the lawsuit, and the Defendant is the party that responds or is possibly responsible for the damages caused to the Plaintiff's person or property. Some of the major cases heard in small claims court include landlord and tenant disputes, property damage, contract disputes, unpaid service fees, and many more. Before you show up for your court hearing, notice will need to be given to the Defendant. SC-100 Process Service

SC-100 is Plaintiff’s Claim and Order to Go to Small Claims Court.  The form is filed and issued by small claims court and will be required to be served on the Defendant. The Defendant will is required to be served 15 days prior to the court hearing and 20 days if they live outside of the county.  

Landlord & Tenant Disputes

There is never not enough landlord and tenant dispute actions that are heard in small claims court. Some of these actions deal with landlords that do not return the security deposit owed to their former tenant. There are also cases where a landlord will take a tenant to court for back rent owed, damage done to property and other issues dealing with tenancy. Small claims court is a inexpensive venue where the plaintiff (person suing) and the defendant (person being sued) can have their claim heard before a judge. There are small claims courts located all throughout Los Angeles County.

Do I need a Lawyer?

In small claims court parties are not and cannot be represented by a lawyer.  The only exception is if there is an appeal from a small claims case and only then you may be represented by a lawyer.  However, prior to the small claims court hearing and after you may consult a lawyer regarding your case.  Small claims court is not as formal as a civil actions heard in limited and unlimited cases where you may be represented by a lawyer.  There are no juries in small claims court.  Each party will be given enough time to present to the judge their case.  It is vital that you bring all evidence that includes and not limited to receipts, witnesses, and photos to support your case.
